If sustained and recorded, those charges could seriously damage the students' standing with their fellow pupils and their teachers as well as interfere with later opportunities for higher education and employment.  It is apparent that the claimed right of the State to determine unilaterally and without process whether that misconduct has occurred immediately collides with the requirements of the Constitution.

The Top 5 Things You Must Do Immediately if your child is suspended...

 
 

1.  Park your anger - You MUST get legal about this and not let your anger waste time

 
 

2.  Most schools have a 10 day (from suspension) appeal rule - Send the appeal letter to the Principal AND The Principal's boss AND the School Board immediately -- DO NOT DELAY!

 
 

3.  You MUST Cite that Due Process was violated in the letter.  In most cases you don't need to list every possible violation, just that due process was violated.

 
 

4.  Get the school rules, school discipline rules and the State Board of Education rules and dive in to find out what they did not do correctly

 
 

5.  Do not sign any school documents that list the charges and do not agree to any charge.  Instruct your child to remain silent if questioned.
